GENERAL CONDITIONS - Zodiac Onlineshop
These are our general terms and conditions. These, together with the references they contain, apply to every agreement that we, Marine Trading International BV ho Zodiac Nederland (with Chamber of Commerce number: 34289630), conclude with you via this WEBSHOP. You agree that the latest version of these terms and conditions will always apply to our agreement.
Article 1 - Products
We sell water sports items such as inflatable boats, outboard motors, parts and accessories.
Article 2 - Payments
The (total) price of the products including taxes and shipping costs is indicated in our webshop before you accept the offer. You pay in advance via our online payment service; Mollie provides this payment service. It is also possible to pay for your order via a regular bank transfer prior to shipment.
If a price change occurs after acceptance of the offer, you will be informed about this and after which you can decide to cancel the purchase.
The shipping costs are for your account. We do not charge shipping costs within the Netherlands for orders from 50 euros.
Article 3 - Deliveries
We deliver your product to the address you specified when ordering. You can no longer change the address if we have already sent the package. DHL, PostNL or another courier service takes care of the distribution. When the package has been sent, you will receive a track & trace code from us, with which you can follow the order. You are obliged to accept the package when it is delivered to you. The risk of damage and / or loss of products rests with us until the moment of delivery to you, unless explicitly agreed otherwise. We do our best to deliver the order as soon as possible. If the order is delayed, we will notify you in writing. We guarantee that you will receive the order no later than 30 days after confirmation of the order. If this unexpectedly does not work,
The delivery times are indicative and do not entitle you to compensation if they are exceeded.
Article 4 - Guarantees
We guarantee that the item(s) sold conforms to the agreement, that it will function without defects and that it is suitable for the use that the buyer intends to make. Article 5 - Return - Right of withdrawal
You may always return the product, if unused, within 14 days after you have received it. You can do this as described on our returns page. After you have received confirmation from us, you must send the product within 14 days. We will refund the full purchase amount within 14 days after registering the return, provided that we have already received the product back in good order.
If we have received the product, we will refund the full purchase amount within 14 days or in case of an incorrect product, we will replace the product with the correct product. The costs for the return shipment are for your account. During the period you have to consider whether you want to keep the product, you must handle the product and its packaging with care. You may only unpack and use the product to the extent necessary to determine whether you want to keep the product. The product can only be returned in new condition, in its original packaging. You cannot return a product with traces of use. Second chance, second-hand and other non-new items cannot be returned by default, unless stated otherwise in the product description.

Article 6 - Liability
We are not liable for damage caused by the use of a product. This does not apply if the damage was caused by our intent, gross negligence or willful recklessness. Your right to compensation will in any case not exceed the amount of the ordered and paid product.
Article 7 - Intellectual property rights
All intellectual property rights (such as: copyrights, logos, word marks) on our texts, photos, images and other materials are our property (or are under our control with the permission of the owner). Your use must not infringe this.
Article 8 - Complaints procedure
If you have a complaint about the implementation of the agreement, please let us know. Send your complaint fully and clearly described to [email protected] within 2 months after you have discovered the defects . We will deal with your complaint as soon as possible, no later than 10 days after we have received your complaint. If it takes longer to settle the complaint, you will receive a confirmation of your complaint within two days and we will let you know when we expect a substantive response.
If your customer is found to be well-founded by us, we will repair or replace the delivered products. If we cannot resolve the complaint among ourselves, a dispute will arise that falls under the dispute settlement procedure.
You have the option, after you have first reported the complaint to us, to report your complaint via the European ODR platform (http://ec.europa.eu/odr).
Article 9 - Dispute settlement
These general terms and conditions and the agreements we conclude with you are governed by Dutch law. In the event of a dispute, the court in Amsterdam has jurisdiction.
